These Terms of Service (“Terms”) govern your access to and use of the website www.embeddedcomputers.ca (the “Site”) operated by Embedded Computers (“we”, “us”, “our”). By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Who we are
Embedded Computers is an online retailer based in Nova Scotia, Canada, selling single-board computers, accessories, and related electronics. You can contact us at support@embeddedcomputers.ca.
2. Eligibility
You must be at least the age of majority in your province, state, or country of residence to place an order. By placing an order you represent that the information you provide is accurate and that you are authorized to use the payment method.
3. Orders, pricing, and payment
All prices on the Site are listed in Canadian Dollars (CAD) unless otherwise indicated. Display in other currencies is provided for convenience and the final charge will be in CAD. We reserve the right to modify pricing, correct pricing errors, refuse or cancel orders, and limit quantities at any time, including after an order has been placed. If we cancel an order after payment has been collected, we will refund the amount charged.
An order is accepted only when we send a confirmation that the order has been shipped. Receipt of an order confirmation email at checkout does not constitute acceptance.
4. Shipping
Shipping rates, transit times, and destinations are described on our Shipping Information page, which is incorporated into these Terms by reference. International orders may be subject to customs duties, taxes, or other import fees imposed by the destination country. Where we collect duties at checkout under a Delivered Duty Paid (DDP) arrangement, that amount is shown as a separate line item; otherwise duties are the customer’s responsibility.
5. Returns and refunds
Returns are governed by our Returns Policy, which is incorporated into these Terms by reference. Please read it before purchasing.
6. Product information and warranties
We make reasonable efforts to describe and photograph products accurately, but we do not warrant that product descriptions, specifications, pricing, or other content on the Site are error-free, complete, or current. Manufacturer specifications are provided as a convenience and are subject to change by the manufacturer without notice.
Single-board computers and related hardware sold on the Site are intended for development, prototyping, education, and hobbyist use. They are not intended or warranted for use in life-support, medical, aerospace, automotive safety, nuclear, or other applications where failure of the product could reasonably be expected to result in personal injury, death, or significant property damage. Use of the products in such applications is at your sole risk.
To the maximum extent permitted by applicable law, products are provided “as is” except for any manufacturer warranty that may accompany the product or any non-excludable statutory consumer rights.
7. Intellectual property
All content on the Site — including text, graphics, logos, photographs, and software — is the property of Embedded Computers or its licensors and is protected by Canadian and international copyright and trademark law. You may not reproduce, distribute, or create derivative works from this content without prior written permission, except for personal, non-commercial use such as viewing product listings.
Third-party trademarks (including but not limited to Radxa, Raspberry Pi, Rock Pi, Linux, and Debian) are the property of their respective owners and are used on the Site for descriptive purposes only. Use of these marks does not imply endorsement or affiliation.
8. Acceptable use
You agree not to use the Site to (a) submit false or misleading information, (b) attempt to gain unauthorized access to any part of the Site, our servers, or any connected systems, (c) interfere with the operation of the Site, (d) use automated tools to scrape, harvest, or copy content except as permitted by our robots.txt, or (e) use the Site for any unlawful purpose.
9. User-submitted content
If you submit reviews, comments, chat messages, or other content to the Site, you grant Embedded Computers a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, modify, and display that content in connection with operating and promoting the Site. You represent that any content you submit is your own and does not infringe the rights of any third party.
10. Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Limitation of liability
To the maximum extent permitted by applicable law, Embedded Computers and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or in connection with the Site or any product purchased through the Site, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or any product purchased through the Site will not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including non-excludable rights under the Consumer Protection Act (Nova Scotia) or comparable consumer-protection legislation in your jurisdiction.
12. Indemnification
You agree to indemnify and hold harmless Embedded Computers from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.
13. Governing law and disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The parties agree to the exclusive jurisdiction of the courts of Nova Scotia for any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the most recent revision. Continued use of the Site after a revision constitutes acceptance of the revised Terms.
